Terms and Conditions for Diners

These Terms govern the use of Food22 interfaces intended for diners, including digital menus, reservations, orders, user accounts, artificial intelligence assistants and communication channels enabled by restaurants.
By using Food22, you accept these Terms to the extent applicable to the service you use.
1. Who provides Food22
The entity providing Food22 depends on the territory from which the service is offered.
Poland and European Economic Area

When the activity begins operating through a registered Polish sole proprietorship (JDG), this section will be updated with the corresponding business details.

2. What Food22 is and is not
Food22 is a technology platform that allows restaurants to display menus, receive reservations and orders, manage customer relationships and use artificial intelligence tools.
Food22 is not a restaurant. It does not prepare food, provide restaurant services or, unless expressly stated otherwise, become a party to the consumer contract between you and the restaurant.
When you reserve a table or place an order, the restaurant provides the main service and is responsible for its performance.
Food22 provides the technological infrastructure needed to facilitate those operations.
3. Use without an account
You may view menus and, where the restaurant allows it, make reservations or place orders without creating an account.
In those cases, only the data necessary to carry out the relevant operation will be requested.
4. Diner account
4.1 Minimum age
To create a Food22 account, you must be at least 16 years old.
If you are under 16, you must not create an account or provide personal data based on consent without authorization from your parent or legal guardian.
4.2 Access and security
Food22 may use access codes sent by email or other authentication mechanisms available on the platform.
You are responsible for keeping access to your email and the devices from which you use Food22 secure.
4.3 Account functions
An account may allow you to view your reservation and order history, save preferences, manage contact details, receive personalization within Food22, rate dishes, manage consents and request export or deletion of your data.
4.4 Account closure
You may request deletion of your account through the available controls or by writing to hello@food22.club.
We will delete or anonymize data that Food22 processes as controller, except data that we must retain temporarily due to legal obligations, pending claims or the establishment, exercise or defense of rights.
Data that Food22 processes solely on behalf of a restaurant will be managed according to the instructions of the restaurant acting as controller.
5. Reservations
5.1 How they work
When you make a reservation through Food22, the system checks availability configured by the restaurant and creates a reservation or reservation request depending on how that establishment operates.
We may ask for your name, phone number or email, date and time, number of diners and comments or special requests.
Some restaurants may confirm automatically, while others may require manual review.
The reservation is subject to the restaurant's operational conditions.
5.2 Modification and cancellation
Where the feature is available, you may modify or cancel a reservation using the confirmation link, your account or other enabled channels.
Each restaurant may set reasonable modification or cancellation limits, and Food22 will display those conditions where applicable.
5.3 No-show, deposits and guarantees
Some restaurants may require a deposit, reservation guarantee or charge for failure to attend.
Where applicable, the amount, conditions, cancellation deadline without charge and any consequence for failing to attend will be clearly displayed before the reservation is confirmed.
Food22 will not apply charges that were not disclosed in advance.
5.4 Waitlist
Where available, you may request to be notified if a table becomes available.
Being placed on a waitlist does not guarantee a reservation.
6. Orders and payments
When a restaurant enables orders through Food22:
- the sales contract is between you and the restaurant;
- the restaurant sets prices, availability, delivery conditions and preparation terms;
- Food22 provides the technological infrastructure;
- online payments are processed by specialized payment service providers;
- Food22 does not store your complete card details.
Refunds, complaints about food, deliveries and order fulfillment are primarily the responsibility of the restaurant, without prejudice to Food22's own responsibility for failures attributable to its platform.
7. Artificial intelligence assistants
Food22 may offer automated assistants, including Foodito, to answer questions, interpret menus, assist with reservations, orders or preferences and, where enabled, interact by voice.
These systems use artificial intelligence and may make mistakes.
AI-generated information is intended as assistance and does not replace direct confirmation from the restaurant where the information is relevant to your health, safety, reservation, order or payment.
8. Voice, calls, SMS and WhatsApp
Some restaurants may use Food22 to provide service through voice, telephone calls, SMS or WhatsApp.
Where a call may be recorded, the user will be informed and the authorization required by applicable law will be requested before recording begins.

9. Allergies and food information
Features relating to allergies, intolerances and dish compatibility are an informational aid, not a food-safety guarantee.
- Ingredient and allergen information comes primarily from the restaurant.
- Automated analysis may contain errors.
- Food22 may not know about recipe changes, kitchen processes or cross-contamination.
- The restaurant is responsible for preparing and serving the food.
If you have a severe allergy or relevant intolerance, always confirm directly with restaurant staff before consuming.
Food22 must not be used as a substitute for medical advice or as the sole source for decisions relating to severe allergies.
10. Ratings and user content
If you publish a rating, comment or other content, you agree not to publish unlawful content, infringe third-party rights, include personal data of third parties without authorization, or publish abusive, misleading or manifestly false content.
Food22 may remove or restrict content that violates these conditions or applicable law.
11. Acceptable use
You may not create false, fraudulent or mass reservations; use unauthorized bots or automation; attempt to access third-party accounts or data; bypass security controls; interfere with Food22's operation; or use the platform for unlawful activities.
We may limit or suspend access where there is a reasonably established breach, fraud, security risk or abuse of the service.
12. Availability and technical changes
Food22 seeks to keep the service available, but does not guarantee uninterrupted or error-free operation.
Interruptions may occur due to maintenance, provider failures, network incidents, updates or causes outside our reasonable control.
We will seek to reduce their impact and correct failures attributable to Food22.
13. Liability
Food22 is responsible for providing its own technology services in accordance with applicable law.
Nothing in these Terms limits consumer rights or liabilities that cannot legally be excluded.
The restaurant is responsible, among other things, for food preparation and quality, in-restaurant service, accuracy of the information it provides about its menu, fulfillment of reservations, preparation, delivery and refund of orders, and compliance with its own obligations toward consumers.
Food22 will not be liable for breaches attributable exclusively to the restaurant or third parties, except where the damage also results from a breach, error or conduct attributable to Food22.
To the maximum extent permitted by applicable law, Food22 will not be liable for indirect or consequential damages that were not reasonably foreseeable.
14. Data protection
The processing of personal data is described in the Food22 Privacy Policy and Cookie Policy.
15. Acceptance and version records
15.1 Account
When creating an account, you will be asked to expressly accept these Terms and will be provided access to the Privacy Policy.
15.2 Reservation or order without an account
Before confirming a reservation or order without an account, a notice with links to these Terms and the Privacy Policy will be displayed.
Confirming the transaction will constitute acceptance of the Terms applicable to that transaction.
Food22 may record the accepted version, date and time, and the relevant account, reservation or order identifier to evidence acceptance.
16. Changes to these Terms
We may update these Terms due to legal, technical, operational or service changes.
If a change is substantial and affects your rights or obligations, we will inform you at least 15 days in advance, unless a legal obligation, security reason or justified urgent cause requires earlier application.
Minor or purely technical changes may take effect upon publication.
17. Governing law and dispute resolution
17.1 Users in Poland and the EEA
These Terms are governed by Polish law, without prejudice to mandatory consumer-protection provisions applicable in the consumer's country of habitual residence.
Where consumer law allows the user to bring proceedings before the courts of their place of residence, these Terms do not limit that right.
17.2 Users in Mexico
These Terms are interpreted in accordance with applicable Mexican law, including non-waivable consumer rights.
Nothing in these Terms limits the consumer's right to approach PROFECO or other competent authorities or courts where applicable.
17.3 Amicable resolution
Before starting formal proceedings, you may write to hello@food22.club to try to resolve the issue directly.
